Judge rejects to repeat trial to Pablo Ibar, on death row since 2000

A Florida judge rejected on Monday an appeal that asked to repeat the trial to Spaniard Pablo Ibar, on death row since 2000 accused of three murders in 1994.

Pablo Ibar stands accused of the murders in 1994 of Casimir Sucharsky, manager of a local bar, and Sharon and Marie Anderson. The crimes were caught on security camera. In prison since 1994, Ibar has always protested his innocence and claims that he was with his then girlfriend (now wife) at the time of the murder.

According to Judge Jeffrey R. Levenson, the British facial recognition expert that testified that there were several discrepancies between the facial characteristics of Pablo Ibar and the author of the triple crime was not qualified enough to establish his report.

The British facial recognition expert came to that conclusion after studying video of the crime caught by security cameras, although the quality of the images was very poor. The difference he found was in the eyebrows.

Lawyer for the defense Benjamin Waxman was deeply disappointed with the ruling and announced he will appeal against the sentence at the Supreme Court of Florida.

The Association against the death sentence of Pablo Ibar expressed their disagreement with the judge's decision and remembered Ibar's former lawyer had recognized his own failings in the case of Ibar, which he put down to personal problems he was suffering at the time. They also pointed out that DNA and fingerprint evidence don't prove Pablo Ibar was at the scenery of the crime.
